For Your Protection:- To protect your personal information direct debit payments are collected through a national finance company called DFC.  In the Toning Centre we are able to update some minimal personal detail via a portal but again, for your protection and security most changes will need to be made through DFC and you directly.  We realise that in some cases this may be a bit of a pain, but we strongly feel that it is worth it to  keep you safe and secure.  Please ask one of our TTT Centre Managers for more detail.

Customer Contract

Definitions: The Service Provider = "We"; The Customer = "You"; Debit Finance Collections Plc = "DFC"

Terms of your Contract

Period of Commitment

You are agreeing to subscribe monthly for the services provided by the Service Provider and contracting to remain a subscriber for the minimum period shown overleaf.

Termination of Service

Limited right to cancel

During the minimum period of the agreement you may cancel the agreement only:

  1. If we fail to maintain the standard of service you would reasonably expect.
  2. If we alter the operating hours of the services unreasonably.
  3. If you develop a medical condition which prevents you from using the services on an ongoing basis. An appropriate medical practitioner must provide written evidence that this is so.
  4. If you move away from the area by a distance which we consider, at our sole discretion, to be too far to travel to the services for regular use. We shall require evidence that such a move has taken place.
  5. If you lose your employment and are unable keep up the repayments as a result. You must produce documentary evidence and initially we shall be prepared to suspend payments for two months and review with you your financial situation thereafter.

Termination Payment for Early Cancellation

If you cancel your subscription during the minimum contracted period, other than in the circumstances set out above, we shall be entitled to a termination payment (a "Termination Payment")
The Termination Payment will be the total of:

  1. The arrears, if any
  2. Any accumulated late payment charges that have been or will be incurred
  3. The monthly subscriptions that would otherwise have fallen due before the end of the minimum contracted period.

You will be given credit for early payment and this will be a discount allowed against the total you have to pay. For details of how the discount is calculated please contact DFC.

 

Missing Payments

If you miss two payments you will be deemed to have breached your contract.

Giving notice to cancel

DFC (The Collecting Agent) will continue to collect your monthly subscription after the minimum contract period. Should you not wish to continue subscribing after the minimum period you must give notice to cancel the contract in the month before the final payment of the minimum period. If you wish to cancel the contract at any time after the minimum contract period you must give one month's notice. The notice should be in writing or by e-mail and sent to the service provider or Debit Finance Collections Plc.

Collecting your monthly subscriptions

Debit Finance Collections Plc ("DFC") is our agent for the collection of your monthly subscriptions. DFC will collect your subscription monthly in advance on our behalf by Direct Debit.

If you fail to make a payment on time you will incur the following charges:
1) Fail to pay the subscription on the due date ..................................................................................................................................£10.00
2) Fail to pay the missed subscription within 7 days of the date of a reminder letter ..................................................................£20.00
3) Fail to pay the arrears and accrued charges within 7 days of the date of a Final Notice ......................................................£30.00
Late payment charges become payable immediately they are incurred.
Other Charges
1) Payment other than by Direct Debit .................................................................................................................................................£5.00
2) Any cheque returned unpaid by your bank..................................................................................................................£10.00

DFC is also our agent for serving notice and collecting any Termination Payment which becomes due. Any notice served on you by the terms of this contract will be deemed to have been delivered to you the next day after it is despatched by us, or our agent.

Data Protection Statement

Debit Finance Collections plc always uses information submitted by you ('Information') in accordance with all relevant data protection legislation. By signing this agreement you confirm your acceptance of the terms of the Data Protection Statement. Debit Finance Collections plc will use information as follows:

  • To supply services as requested by you including the transfer of information to employees, agents and third parties as required for this purpose.
  • For administration purposes
  • To market Debit Finance Collections plc services to you.

 

Debit Finance Collections plc may also disclose details of your account to a debt collecting agency for collection and tracing purposes.
Debit Finance Collections plc may transfer its business assets (which include information) on sale or merger of its business.

The Data Protection Act 1998 gives you certain rights, including the right to request a copy of your information and to have inaccurate information corrected. Please contact the Data Protection Manager, Debit Finance Collections plc, PO Box 6046, Milton Keynes, MK1 9BA.

This guarantee should be retained by the Payer

The Direct Debit Guarantee

  • This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.

  • If there are any changes to the amount, date or frequency of your Direct Debit, will notify you 5 working days in advance of your account being debited or as otherwise agreed. If you request to collect a payment, confirmation of the amount and date will be given to you at the time of the request.

  • If an error is made in the payment of your Direct Debit, by or your bank or building society you are entitled to a full and immediate refund of the amount paid from your bank or building society. 

    - If you receive a refund you are not entitled to, you must pay it back when asks you to.

  • You can cancel a Direct Debit at any time by simply contacting your bank or building society. Written confirmation may be required. Please also notify us.

A copy of our T&Cs will be given to you at the centre upon joining.  A copy of DFC T&C's will be both emailed and sent to you after joining.

Toning Centre Terms & Conditions

Terms & Conditions of use of Toning Table Therapy Centre (TTT).

All members are responsible for complying with the following terms & conditions, which are in place for the enjoyment and safety of TTT members and staff.

·         The TTT centre should be used in accordance to the centre etiquette & rules displayed.

·         A TTT appointment card will be issued at time of joining.  This card to is to record your appointment times.  Please bring this with you each time you visit TTT’s.

·         TTT endeavour to ensure the centre is available during the advertised opening times.  However, occasionally, due to circumstances beyond our control, the centre may be unavailable or sessions cancelled. Prior notice will be given where possible.

·         TTT membership Direct Debit contracts, offer an easy monthly payment scheme.  The cost is spread over 12 monthly instalments, the payments are collected by Debit Finance Collections (DFC).  A member may pay the remaining balance of their contract at any time.  This is a rolling contract and payments continue into month 13 and beyond where there is no price increase.  The member must notify DFC with 30 days’ notice that they wish to cancel.  The contract does not automatically terminate after the twelfth payment.

·         If TTT or the bank/building society makes a mistake with your direct debit payment you are guaranteed a full and immediate refund from your bank/building society

·         Monthly instalments will be due on either the 1st , 8th, 15th or 25th of each calendar month or the next available working day by Direct Debit

·         Monthly fees are payable even if you do not use the centre

·         Should TTT have planned redecoration, advance notice will be given to all affected members and during these periods it may be necessary to restrict access to the centre for a small period of time. Whilst we recognise this can sometimes be an inconvenience, we will keep disruption to a minimum.  We are unable to refund memberships during any such period.

Cancellations Annual memberships cannot be cancelled prior to the expiry date/twelfth payment has been made.  If, in extreme circumstances the contract cannot be fulfilled it can be transferred to another person.  If due to relocation (minimum distance 20 miles from Harlow), membership can be cancelled, providing sufficient proof.  A contract maybe cancelled once the twelfth payment has been made, this requires 30 days’ notice in writing to Debit Finance (email info@debitfinance.co.uk).  A confirmation letter/email will be sent back.  Queries on cancelled memberships can only be dealt with when a copy of this letter is provided.  Contact Debit Finance Customer Service on 01908 422000.

·         To avoid charges – please do not cancel your direct debit without speaking to the TTT Team or DFC directly during your 12 month contract

·         Annual up front memberships cannot be refunded under any circumstances.

Frozen Payments

Payments may be frozen providing valid proof where the user is unable to use the club for a minimum period of 1 month, minimum notice period 14 days before next payment due and must be accompanied by a Specialist/Medical confirmation/advisory letter.  You will receive an email/confirmation from the Club Manager, confirming the duration that your membership is frozen.  Queries on frozen memberships can only be dealt with when a copy of this letter is provided.  During the life of a membership the contracts can only be frozen for a maximum of six months. Frozen payments will be added to the end of your contract. 

5 Day Passes

5 Day Pass members agree to adhere to all terms and conditions set out by TTT with exception of those concerning Direct Debits.

Explanations of other costs

Pro Rata (non-refundable) – This payment covers the cost of using the centre straight away until the first payment is made.

Admin Fee (non-refundable) - £25 – This is the charge for setting up the membership, postage, contract process, membership card & membership information pack, plus any costs throughout the life of their membership.

 

Banning

The management team reserve the right to terminate or temporarily suspend the membership of any person breaching rules & regulations, or for any other reason the management team deems appropriate.  Membership already paid/pro rate or in full cannot be refunded in these circumstances.

 

Screening – PAR Q

  • The PAR Q form contained within the Medical Questionnaire pack & liability waiver must be complete and returned to a member of the team prior to using the centre.

·         All centre users are required to attend an induction.

General Information

No food or drink may be brought in to and consumed within TTT centre. With the exception to drinking water and hot drinks from the vending machine, to be consumed in waiting area only.  All users of TTT centre must observe the rules and comply with any directions the management may give to ensure the smooth, safe and efficient operation of the site.  TTT reserve the right to alter and amend these rules at any time.  To meet the agreed terms & conditions by signing this document TTT customers agree that all records provided are correct and MUST notify a member of staff immediately if there are any changed to personal information including medical, personal and ban details.  Without correct details members will miss out on deals & offers TTT provide.

Please ensure you update your records if you move or change your phone number.  Thank you.

Setting up Direct Debit - I do not have an email address

When setting up a Direct Debit online at the centre, if you do not have an email address.  TTT give you permission to use the centres email address:  toningtabletherapycentre@outlook.com.  An immediate response from DFC will be received, printed and given to you for your approval.  All emails will be deleted from TTT inbox and trash and no personal details will be held on TTT records.  To approve this please sign below to show you have agreed to this action.

 

I hereby authorise the use of toningtabletherapycentre.co.uk email address to be used during the setup of the online Direct Debit via DFC.

*Frozen Payments

As per terms and conditions above, payments can be frozen up to six months (with correct notifications).  Payments then become due, when frozen period has ended, or sixth month period has ended, which ever is earlier.  Contract is for 12 payments which is usually spread over 12 months.
